Assumption of Risk: I, the undersigned, understand that BestoEPV and its respective affiliates, owners, officers, employees, representatives, volunteers, and agents will do their best to prevent participants from sustaining bodily injury, harm, or damage to property. I acknowledge that neither BestoEPV nor its respective affiliates, owners, officers, employees, representatives, volunteers, and agents are responsible for the conduct of other persons, or for weather or water conditions. I acknowledge that I am not required to participate in any of the activities presented to me, but that I have willingly and voluntarily decided to participate.
I understand and accept participating in biking exposes me to many hazards and entails unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I understand that this activity may result in hazards posed by other bicycles and traffic or road conditions among other things. I also understand I should be in good physical health to participate in bicycling. I choose to participate in bicycling in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of participating in bicycling. I understand the inherent risk involved in participating in this tour and accept full responsibility for any and all such damage or injury which may result.

Waiver & Release: I SPECIFICALLY RELEASE AND FOREVER DISCHARGE BestoEPV its officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while participating in bicycling and this tour. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damaged caused by the negligence BestoEPV or its officer agents, or employees. It is my intent by the Waiver and Release Agreement to release BestoEPV and hold it harmless from all liability for any such property loss or damage, personal injury, or loss of life, whether caused by negligence of BestoEPV or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in in this tour or participating in bicycling, I will have no right to make a claim or file a lawsuit against BestoEPV, its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage. I REALIZE THE IMPORTANCE OF WEARING A HELMET AND APPROPRIATE FOOTWARE/GEAR AND I ACKNOWLEDGE THAT I SHOULD WEAR A HELMET AT ALL TIMES DURING THIS TOUR. I understand that BestoEPV will provide me with a rental helmet at no cost. I understand that wearing a helmet is NOT a guarantee of protection from injuries. I understand how to operate the bicycle and brakes and how to adjust the seat and quick releases. The BestoEPV staff or delegate have answered any questions that I have. I understand how to wear the helmet and how to adjust so that I have the proper fit. I accept full responsibility for care of the Equipment while it is in my possession. I agree to reimburse BestoEPV for any loss or damage other than reasonable wear resulting from normal use. I agree that all disputes arising under this contract shall be litigated exclusively in the county of ANTIGUA AND BARBUDA and interpreted solely under the laws of ANTIGUA AND BARBUDA. I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY.
I ALSO UNDERSTAND THAT I AM PROHIBITED FROM USING ANY EQUIPMENT AND PARTICIPATING IN THIS TOUR WHILE I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.

LIKENESS RELEASE: I, the undersigned, hereby consent to having my picture taken and likeness recorded in connection with the BestoEPV’s (‘Company”) website, social media, educational and marketing publications. I give the Company and it successors and assignees, the right to use, reproduce, publish or distribute my name, likeness, photograph(s), voice and biographical material about me for educational, publication or marketing purposes without any compensation to me. I understand that the Company shall have total and exclusive control over the use of my name, likeness, photograph(s), voice and biographical material about me for the purposes stated herein, and I waive any right to inspect or approve any proposed publication, in any medium. I agree that the use of my name, likeness, photograph(s), voice and biographical material about me by the Company confers upon me no rights to use, ownership or copyright. I release the Company and its owners, directors, officers, employees, agents, contractors (including photographers and videographers) and assigns from all liability which may arise from any and/or all claims by me or any third party in connection with the use and/or publication of my name, likeness, photograph(s), voice and biographical material about me. I acknowledge and agree that I am eighteen (18) years of age or older. I have read this release thoroughly and understand its terms. I acknowledge and agree that no representation has been made by the Company and relied upon by me as to my future income, expenses, sales volume, or potential profitability of future success that may be derived from the use of my name, likeness, photograph(s), voice and biographical material about me.
I certify that I am 18 years of age or older, and I have read and agreed to all of the Terms and Conditions set forth in this Agreement.
